By accessing or using Hermes Agent (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service.

What the Service Does

Hermes Agent helps you launch, run, and manage deployed assistants across supported channels and models. Features may change as we improve the service.

Service Disclosure

Hermes Agent is an independent deployment platform. We are not affiliated with, endorsed by, or sponsored by third-party model or channel providers.

Accounts

• You must provide accurate registration information and keep your credentials secure.
• You are responsible for activity under your account.
• Notify us promptly if you suspect unauthorized access.

Your Data and Rights

• You retain ownership of your data and configuration submitted through Hermes Agent.
• You grant us a limited license to store, process, and transmit your data solely to provide the Service.
• You represent that you have the rights and permissions needed to connect channels and deploy assistants.
• We do not use your private deployment data to train public models.

Acceptable Use

You agree not to:

• Use the Service for illegal, harmful, or abusive activity.
• Attempt to attack, disrupt, reverse engineer, or bypass platform safeguards.
• Circumvent plan limits or resell access without permission.
• Deploy assistants that violate applicable law or third-party platform rules.

Plans, Payments, and Deployment Quotas

• Plans, deployment limits, and features are described on the pricing page.
• Payments are processed by third-party providers.
• Subscriptions renew automatically unless canceled before renewal.
• You may cancel at any time; cancellation applies at the end of the current billing cycle.
• Unless required by law, charges are non-refundable after the billing period starts or quota has been materially consumed.

Refunds and Support

• Refund eligibility is governed by our Refund Policy.

• We aim to respond within 3 business days.

Availability and Changes

We strive for reliable uptime, but availability can be affected by maintenance, incidents, or third-party dependencies. We may modify features, limits, and pricing with notice.

Intellectual Property

The Hermes Agent service, software, interface, and branding are owned by Hermes Agent or its licensors. These Terms do not transfer ownership rights to you.

Disclaimers

The Service is provided "as is" and "as available" without warranties. We do not guarantee uninterrupted operation or specific outcomes for every deployment.

Limitation of Liability

To the fullest extent permitted by law, Hermes Agent and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/data. Our aggregate liability is limited to the amount you paid for the Service in the six months before the claim.

Indemnification

You agree to indemnify and hold harmless Hermes Agent, its affiliates, and personnel from claims, damages, and expenses arising from your use of the Service, your deployments, or your violation of these Terms.

Termination

We may suspend or terminate access if you violate these Terms or create legal/security risk. You may stop using the Service at any time. Provisions that should survive termination will continue to apply.

Governing Law and Disputes

These Terms are governed by applicable law in your jurisdiction unless local law requires otherwise. Disputes are resolved in courts with proper jurisdiction unless arbitration is required by law.
